Deferred Payment Agreements
Criminal Division

A deferred payment agreement shall only be considered on fines and costs totaling $200.00 or more.

A six (6) month deferred payment agreement shall be considered on fines and costs totaling $200.00 to $500.00 and are subject to the following conditions:

  • $100.00 initial down payment for first agreement ($200.00 for second agreement)

  • If the defendant cannot pay the initial down payment, defendant shall complete and sign the DC 333 (Financial Statement), be sworn by the Deputy Clerk, waiver of this payment shall be at the discretion of the Department Managers

  • Defendant shall read, sign and date in the presence of the deputy clerk, the Accepted Methods of Payment and CC-1379(B).

  • 2 deferred payment agreements allowed (upon second default, matter will be referred to the collection attorney)

A one (1) year deferred payment agreement shall be considered on fines and costs totaling above $500.00 and are subject to the following conditions:
  • $100.00 initial down payment for first agreement ($200.00 for second agreement)

  • If the defendant cannot pay the initial down payment, defendant shall complete and sign the DC 333 (Financial Statement), be sworn by the Deputy Clerk, waiver of this payment shall be at the discretion of the Department Managers

  • One (1) year return court date (FTP and FTA, disposition at discretion of the Court)

  • Defendant shall read, sign and date in the presence of the deputy clerk, the Accepted Methods of Payment and CC-1379(B).

  • 2 deferred payment agreements allowed (upon second default, matter will be referred to the collection attorney)

Defendants that have been convicted, receive active incarceration and immediately taken into custody are not eligible for a deferred payment agreement. Individuals should report to the Circuit Court Clerk’s Office upon release from incarceration to set up a deferred payment agreement.
