What is a Conditional Use Permit For An Excavation/Borrow Pit?

Section 26-241 of the Chesapeake City Code states that no person shall excavate a borrow pit within the City without first having obtained a Conditional Use Permit from City Council. Certain land uses, such as excavations/borrow pits, require intensive review to determine whether they are appropriate in specified situations and whether special conditions would make the land use sufficiently compatible with the immediate area to warrant the granting of a use permit for the proposed use.

 

Application Deadline

Monday prior to the 2nd Wednesday of the month by 5 p.m.

Applicant Responsibilities

  1. A complete Conditional Use Permit (CUP) for an Excavation/Borrow Pit application form.
    The original and two (2) copies of the complete Rezoning application, with ORIGINAL SIGNATURES ON ONE COPY, including all required development information.
  2. Legal Description and common street address of the property
    (pg. 3-Description of Property portion of the Rezoning application)
  3. Payment of Filing Fee
  4. Assumption of Legal Responsibility (pg.10)
  5. Special Power of Attorney, if applicable (pg.11)
  6. Statement of Ownership
    (pg.12 - Rezoning application)
  7. Adjacent Property Owners list of names and addresses
    (pg.12 - Rezoning application)
    Stamped #10 (4 1/8" x 9½") envelopes with the name and mailing address of each adjacent property owner printed legibly.
  8. Sign Posting (supplied by the Planning Department) two Wednesdays prior to the Planning Commission Public Hearing, Sign Fees

  9. Advertising Fees will be billed separately. The average advertising cost is $ 100 for the Planning Commission Public Hearing and the average is between $ 400 to $ 1,000 for the City Council meeting. The project will require a minimum of four ( 4 ) advertisements. Any additional advertising costs incurred due to continuances or revised proffer statements will also be the responsibility of the applicant. Planning Commission advertisement fees will be billed by the City of Chesapeake. City Council advertisement fees will be billed by the Virginia Pilot.

      Map of the property - reduced to 8½” x 11” paper.
      Vicinity Map - reduced to 8½” x 11” paper.
  11. Preliminary Site Plan of the proposed development, drawn to scale
    Submit 30 copies, plus 3 copies reduced to 11" by 17" paper, plus 3 copies reduced to 8 ½" by 11" paper
  12. Landscape Plan
    Three (3) copies reduced to 11” by 17” paper and three (3) copies of this plan reduced to 8 ½” by 11” paper, this information may be shown on the preliminary site plan
  13. Topographic Map
    Three (3) copies reduced to 8 ½" by 11" or 8 ½" by 14" paper
  14. Hydrology Study
    Three (3) copies on 11" by 17" paper
  15. End Use Plan
    Three (3) copies on 11" by 17" paper
